Prop 57: Doubling Down on Disaster
To say 2016 has been a particularly deadly year for American law enforcement officers would be an understatement. Four officers were murdered in California last month, and at least three of them died for the very same reason: People who should have been incarcerated were out on the streets. And it's only going to get worse if Gov. Jerry Brown and other leading proponents of prison reform get t

  • What makes a record legally defensible?

What makes a record legally defensible?
There are really two interdependent components of this question: defensible training and defensible records. Great training loses much of its value if its undocumented, and meticulous records of inadequate training will seldom help your case.  For training to be legally defensible, it must be relevant to the learner’s job function or responsibilities, delivered by an instructor qualified or certified to teach that topic, and designed to improve or refresh desirable behaviors.  Fo
  • What is spoliation and how can we avoid it?

What is spoliation and how can we avoid it?
Spoliation refers to the failure to preserve relevant evidence. In some jurisdictions, it can serve as an independent basis for a lawsuit, but most commonly it results in a jury being instructed to make an adverse inference against the spoliator regarding the contents of the evidence.  Courts require only negligence in some places, so spilling your coffee on an important paper file may end up costing your department thousands of dollars. Spoliation is best avoided by creating complete recor
  • Do we need to retain original copies of course completion diplomas?

Do we need to retain original copies of course completion diplomas?
Generally speaking, no. Under Federal Rule of Evidence 1003, copies are admissible to the same extent as the originals unless there is a genuine question as to the authenticity of the copies. In most cases, you usually do not need to maintain copies of the diplomas, either, so long as you maintain records of the underlying training event and student completion data.

  • Can we just keep our records in a record book?

Can we just keep our records in a record book?
Sure you could, in much the same way that your department could be using battle axes or bows and arrows instead of guns to defend themselves. Either scenario places your officers at greater risk by using old technology, and will end up costing your department more in the long run.  Paper records are expensive to print and store, time consuming to sift through, nearly impossible to track, easy to misplace, and more susceptible to claims of tampering.  If it takes you more than a few cli
